Mapping of claims against insurance intermediaries
Italy has the largest number of insurance distributors in the European Economic Area, making it one of the strongest markets in Europe for intermediation.
In Italy, recent litigation has focussed mainly on issues related to premiums and fraudulent acts, particularly by agents.
However, it is noteworthy that the courts tend to attenuate the intermediary’s liability to a certain extent if insureds do not fulfil their obligations. Indeed, the Italian courts emphasise that insureds may not be exonerated from their responsibilities and must themselves act in accordance with their
contractual obligations and cannot systematically hold the intermediary liable.
